The visa you apply for may allow you to stay in Australia:

Note that, a visa that allows you to stay in Australia permanently (permanent residence visa) does not automatically turn you into an Australian citizen.

 

Note the following about visas

  • Every visa has conditions attached to it. These must be strictly observed by the visa holder.
  • A visa may be cancelled or revoked for one or more reasons

WHAT IF YOUR VISA APPLICATION IS REFUSED

 

INTERNAL REVIEW

If unsuccessful, the letter from the Department will give you reasons for the refusal.

If your application is refused by the Department, you may ask for an internal review which will be conducted by another departmental officer, usually a more senior one. We can help with this process. Contact us to get more information how.

If an application for a visa has been refused, we will:

  • study the reasons given for the refusal
  • identify any errors of fact or law

WHAT IF YOUR VISA IS CANCELLED?

 

In general, the Minister may cancel a visa on several grounds, including:

  • its holder has not complied with a condition of the visa
  • potential risk to the health, safety or good order of the Australian community or individuals:
  • the Minister is not satisfied as to the visa holder’s identity
  • that the visa was obtained on incorrect information
  • that the visa holder paid a person to sponsor him/her
  • the visa holder was convicted of certain offences in Australia

 

OUR SERVICES IF YOUR VISA IS CANCELLED

 Where an application for a visa has been refused, we will:

  • study the reasons given for the refusal & identify any errors of fact or law
  • give you our opinion on whether or not to take the matter further, based on the facts and law & take any of the following actions, if necessary
  • make representations to the Minister
  • prepare submissions for a review on the merits in the AAT
  • prepare submissions for use in the Federal Circuit Court or the Federal Court, as the case may be
  • represent you in the Federal Circuit Court or the Federal Court, as the case may be.
